POLICIES, WARRANTIES, AND DISCLAIMERS
CREDIT POLICY
We require all customers who desire credit to submit a credit application for approval. On any returned check, there will be a $35charge. After a returned check, payment must be cash or money order. We require corporations to give a written personal guarantee of payment.
TERMS OF SALE
Our billing cut-off date is the last day of every month. All invoices received during that period are due on or before the 10th of the following month. If payment is not received by the 10th, no future order will be shipped until the balance is paid in full. Late charges will accrue at 1 ½% per month.
SHIPPING POLICY
We make every reasonable request for deliveries. We pride ourselves in on-time deliveries. We occasionally make job site deliveries, but only when notified in advance and then only on large orders. We feel a $40 charge for job site deliveries is justified since it delays our drivers and increases labor and transportation cost. We will make every effort to be helpful, but due to the liability factor, at no time are our drivers to be expected to carry products into homes or construction sites.
ORDER CANCELLATIONS
Our products are custom made especially for you. If your order is in process when you request cancellation, you will be billed for that part of the order produced.
Limited Warranties
K&D Marble warrants it’s manufactured and sold products for materials and workmanship for the period as follows: (1.) Electric Whirlpool Motors – 3yrs. (2.) Inline Heaters – 1yr. (3.) Marble Tubs – 3yrs. (4.) Vanity Tops & other marble products – 3yrs. (5.) Whirlpool Pumps – 3yrs. These warranties are extended exclusively to the original buyer and are non-transferable. All other warranties are disclaimed.
The discovery of any warranted defect should immediately be brought to the attention of K&D Marble by certified mail. The buyer’s only remedy for warranted defects is limited to the repair or replacement of the defective product(s), at the option of K&D Marble. The buyer is responsible for the cost of removal and reinstallation of the defective product(s) and is responsible for transportation if K&D Marble authorizes the return of the defective product(s).
Warranties are not applicable if the product(s)is installed or used in a manner that is adversely effective; damaged in transit by other than K&D Marble vehicles; chipped or cracked by reasons other than materials and workmanship by K&D Marble; exposed to water temperatures exceeding 140º F.; incidentally or consequentially damaged; reflects impurities inherent to natural fillers; used for purposes other than it’s design; varies from color sample due to nature of materials used or manufacturing process; installed of Non-Factory Authorized Accessories; or if installed plumbing or electrical wiring is changed or modified.
These limited warranties contain no promises, terms, conditions, or warranties other than those specified. These warranties shall be deemed executed in the State of Mississippi and shall be governed by and construed in accordance with the laws of the State of Mississippi. The buyer consents and submits to the jurisdiction of the courts of the State of Mississippi for the purpose of enforcing these limited liabilities.
MARBLE SAMPLES DISCLAIMER
MARBLE IS A UNIQUE PRODUCT. NOT UNLIKE NATURAL MARBLE, THE COLOR INTENSTIY AND VEINING OF EACH PART IS DIFFERENT FROM THAT OF ANY OTHER PART. VARIATIONS IN SHADING AND VEINING ARE INHERENT CHARACTERISTICS OF THE PRODUCT AND ONE OF ITS BEAUTIES. WE PROVIDE SAMPLES AS A BASIC COLOR REFERENCE AND WE WILL NEVER IMPLY THAT THE PART SHIPPED WILL BE AN EXACT CARBON COPY OF THE SAMPLE. THERE IS AN ACCEPTABLE DEGREE OF VARIATION FOR WHICH ALLOWANCES MUST BE MADE.
Note: Custom colors are available and specific color matches are possible but orders placed will require approval of our sample in advance. All custom colors will justify a 20% surcharge.
